Terms of Use

These Terms of Use ("Terms") govern your use of phillyportables.com (the "Site"), operated by USA Venture Group LLC, doing business as Philly Portables ("we," "us" or "our"). By using the Site, requesting a quote or accepting an estimate, you agree to these Terms. If you don't agree, please don't use the Site.

1. Our Services

We rent portable restrooms, hand wash stations, ADA accessible units, roll-off dumpsters and ground-level storage containers, with delivery, scheduled service, swaps and pickup in Philadelphia and the surrounding area. The Site describes these services in general terms. Equipment is supplied through our fulfillment partners as well as our own fleet, and we remain your point of contact for the rental.

2. Quotes, Estimates and Rental Agreements

Pricing is provided by quote or estimate only. A quote is based on the information you give us (location, dates, rental length, the number and type of units, service frequency, the material going into a dumpster and site conditions) and may change if that information changes or proves inaccurate. A quote is not a reservation until we confirm it.

Every rental is governed by the estimate you accept and the rental terms that come with it. Together they set out the equipment, dates, service schedule, price, payment terms, cancellation and rescheduling terms, and responsibility for loss or damage. If anything on the Site conflicts with your accepted estimate, the estimate controls.

3. Payment

Payments are processed by Stripe, our payment processor. When you pay online, your card or bank details go directly to Stripe; we never see or store your full card number. For construction and long-term rentals billed by the 28-day period, you authorize us to charge the payment method you save with Stripe for each period until the equipment is picked up, and we email a receipt for each charge. For event rentals, payment in full reserves your dates. Pennsylvania and Philadelphia sales tax is added where it applies. Returned payments, chargebacks and late payments may be charged the costs we incur.

4. Customer Responsibilities

Unless your accepted estimate says otherwise, as the renter you agree to:

• provide safe, clear access for our trucks to reach the placement area for delivery, servicing and pickup;
• provide a reasonably level, stable placement spot and tell us about gates, codes, overhead lines and site hazards;
• obtain any permit, license or approval required for placement, including the City of Philadelphia dumpster license and medallion and any Streets Department right-of-way permit for equipment on a street or sidewalk;
• not move, tip or relocate units or containers yourself; call us and we will relocate them;
• keep restrooms free of trash, hazardous or flammable materials, chemicals, paint, concrete, fuel and anything other than normal human waste and toilet paper;
• keep prohibited materials out of dumpsters (including hazardous waste, tires, batteries, paint, oil, propane, refrigerants, asbestos and anything the disposal site refuses) and not load a dumpster above its rim or its weight allowance;
• use storage containers only for lawful, non-hazardous, non-perishable goods, and keep them locked;
• protect the equipment from fire, vandalism, theft and misuse while it is on your site; and
• tell us promptly about any damage, tipping, leaks or problems with the equipment.

You are responsible for loss of or damage to the equipment while it is in your care, other than ordinary wear, and for overweight, contamination or disposal charges caused by what was placed in a dumpster.

5. Service, Scheduling and Delays

We schedule deliveries, service visits, swaps and pickups in windows, not at exact times. Weather, traffic, road closures, disposal site hours and site access can move a window. We will tell you when a schedule changes. If we can't reach or service equipment because of a blocked, locked or unsafe site, a trip charge may apply and the service is rescheduled.

6. Equipment Descriptions

Photos and descriptions on the Site are illustrative. Colors, models and features vary. Dumpster dimensions, capacities and weight allowances are typical figures and the box delivered may differ slightly. We will match the equipment on your estimate.

7. Use of the Site

You may use the Site to learn about our services and request quotes. You agree not to misuse the Site, including by submitting false information, attempting to access areas not intended for you, interfering with the Site's operation or scraping its contents. Job pages and estimate pages are private, made for one customer; don't share them beyond the people who need to see them.

8. Intellectual Property

The Site, its text, images, logos and design are owned by USA Venture Group LLC or used with permission, and are protected by copyright and trademark law. You may not copy or reuse them without our written permission. Stock photography is used under license; attribution is listed in our site credits.

9. Disclaimers

The Site is provided "as is." We make no warranty that the Site will be uninterrupted or error-free. Guides on the Site explain rules and regulations in plain language for your convenience; they are not legal advice, and you are responsible for confirming the requirements that apply to your project.

10. Limitation of Liability

To the fullest extent permitted by law, USA Venture Group LLC and its owners, employees, partners and suppliers are not liable for indirect, incidental, special or consequential damages arising from the Site or a rental, including lost profits or project delays. Our total liability for any claim relating to a rental is limited to the amount you paid us for that rental.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, fines and costs (including reasonable attorney's fees) arising from your breach of these Terms or your rental terms, your use of the equipment, what was placed in it, or a placement that lacked a required permit or license.

12. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to their jurisdiction. Nothing here limits any right you have under consumer protection laws that cannot be waived.

13. Privacy

Our Privacy Policy explains what we collect through the Site and how we use it, and is part of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The date at the top shows the latest version. Changes apply to your use of the Site after they are posted; an accepted estimate keeps the terms in force when you accepted it.
